These Terms of Use govern your use of the PATANYX website at patanyx.net, the download and update services operated by EdgeXene LLC, and the PATANYX Browser application. By using the website, you agree to these terms. If you do not agree, do not use it.
PATANYX is under active development and is currently a prerelease build. These terms are in effect now, from the date recorded above, and they cover the prerelease as well as this website and the download and update services: downloading, installing or using PATANYX means you agree to them. They were previously published without an effective date, which left everyone using the prerelease covered by nothing; that is corrected here rather than deferred to a release that has not happened. A revised version will take effect at the Stable Release and will supersede this one.
You must be old enough to form a binding contract in your jurisdiction in order to accept these terms.
These terms do not replace the software license. PATANYX Browser is licensed under the Apache License, Version 2.0. That license alone governs your rights to use, copy, modify and redistribute the software, and nothing here limits, revokes or adds conditions to it. These terms cover what the Apache license does not: the website, the services EdgeXene operates, and the relationship between you and EdgeXene LLC. Where these terms and the Apache License conflict on any matter the Apache License addresses, the Apache License controls.
PATANYX is a desktop web browser for Windows and Linux, developed by EdgeXene LLC. Alongside the application, EdgeXene operates a website that distributes it and a network service that publishes signed update manifests and signed lists of malicious and tracking domains.
EdgeXene does not operate the sites you visit, does not operate VPN servers, and does not operate the DNS resolvers or search engine the browser can be pointed at. Those are third parties, described in our Privacy & Compliance Policy, and your dealings with them are governed by their own terms.
Donations. The website links to a payment page operated by Stripe where you may donate to EdgeXene's open-source work. A donation is a gift, not a purchase. It buys no license, no feature, no support entitlement and no warranty, and PATANYX is identical whether you donate or not. Donations are voluntary and, because nothing is supplied in return, are not refundable except where law requires it or where a payment was made in error, in which case write to us and we will refund it. Your payment itself is governed by Stripe's terms. PATANYX Premium is an optional paid term covered by Section 23. The browser itself remains free, and no free feature has been moved behind payment.
PATANYX requires no account. There is no registration, no sign-in and no credential held by EdgeXene, so there is nothing for you to secure with us and nothing for us to suspend. Access to the software is not conditioned on identifying yourself.

Because PATANYX holds your data on your own machine and EdgeXene holds no copy, certain responsibilities are unavoidably yours.
PATANYX is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. This mirrors and does not enlarge the disclaimer in Section 7 of the Apache License, Version 2.0.
EdgeXene does not warrant that PATANYX will be uninterrupted, error-free or secure, that defects will be corrected, that the update or blocklist services will be available at any given time, or that the browser will block any particular tracker, advertisement or malicious site. Pre-1.0 software carries materially more risk than a finished release, and you accept that risk by using it.
To the maximum extent permitted by law, EdgeXene LLC and its members, officers and contributors shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, loss of privacy, loss of profits, business interruption, or cost of substitute software, arising out of or relating to your use of or inability to use PATANYX or the website, under any theory of liability, even if advised of the possibility of such damages.
To the maximum extent permitted by law, the total aggregate liability of EdgeXene LLC arising out of or relating to these terms or to PATANYX shall not exceed the greater of the amount you paid EdgeXene for PATANYX in the twelve months preceding the claim, or five hundred United States dollars. A donation is not an amount paid for PATANYX and does not raise this limit.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. Where that is so, the exclusions and limitations above apply only to the extent permitted, and nothing in these terms excludes liability for fraud, for death or personal injury caused by negligence, or for any other liability that cannot lawfully be excluded.
You agree to indemnify and hold harmless EdgeXene LLC and its members, officers and contributors from any claim, demand, loss or expense, including reasonable legal fees, arising out of your misuse of PATANYX or the website, your violation of these terms, your violation of any law, or your infringement of the rights of a third party. This does not apply to claims arising from EdgeXene's own conduct.
This section applies only where you use PATANYX in the course of a business, trade or profession. If you are a consumer, it does not apply to you.
You may stop using PATANYX at any time by uninstalling it. Because there is no account, there is nothing to close and no request to make of us.
EdgeXene may discontinue the website, the download service or the update service at any time, and may block access to those services by anyone abusing them. Discontinuing a service does not revoke your rights under the Apache License in a copy of the software you already hold; a copy of PATANYX already installed continues to be yours to run under that license.
PATANYX Browser is licensed under the Apache License, Version 2.0. A copy accompanies every build, along with a NOTICE file and a full inventory of third-party components and their licenses.
The Apache License grants no rights in trademarks. The PATANYX name, the PATANYX logo and mark, the EdgeXene name, and the associated branding on the website remain the property of EdgeXene LLC. You may refer to PATANYX by name to describe it accurately. You may not use the name or marks for a modified build, a competing distribution, or anything that would suggest EdgeXene produced or endorsed it, without prior written permission.
Website content that is not part of the software, including page copy, images and layout, is the property of EdgeXene LLC.
If you send EdgeXene ideas, bug reports, feature requests or other feedback, you grant EdgeXene a perpetual, irrevocable, worldwide, royalty-free license to use it without restriction or obligation to you. We would rather receive a good idea than negotiate for it. Do not send us anything you consider confidential, and do not send us material you are not free to give.
PATANYX reduces what you leave behind. It does not make you anonymous and does not claim to. It provides no onion routing and no protection against traffic-pattern analysis. Its anti-fingerprinting adds noise to some browser readouts; it does not make you unidentifiable, and other signals remain readable. A network operator, a VPN provider you chose, or a site you visit can still observe things about you.
The limits are stated in full on the About page, and you should read them before relying on PATANYX for anything consequential. Nothing in the product or its marketing is a warranty of protection, and PATANYX is not a substitute for professional security advice appropriate to your situation.
Any dispute arising under these terms shall be resolved exclusively in the state or federal courts located in Indiana, United States, and you consent to the personal jurisdiction of those courts.
Nothing in this section deprives you, as a consumer, of the protection of any mandatory rule of law of the country in which you reside, including any right to bring proceedings in the courts of that country. Where such a rule applies, it prevails over the preceding paragraph.
EdgeXene LLC may modify these terms at any time. For material changes we will update the effective date, record the change in the changelog below, and note it in the release that introduces it. Continued use after a change constitutes acceptance of the revised terms. While PATANYX remains pre-1.0, expect these terms to change more often than they would for a finished product.
Failure by EdgeXene LLC to enforce any right or provision of these terms shall not constitute a waiver of that right or provision.
EdgeXene LLC is not liable for any failure or delay in providing the website, the download service or the update service caused by circumstances beyond its reasonable control, including network or infrastructure failure, outage at a hosting or connectivity provider, natural disaster, war, civil unrest, labour action, or governmental action.
If any provision of these terms is held unenforceable, that provision shall be limited or removed to the minimum extent necessary and the remaining provisions shall remain in full force and effect.
These terms are governed by the laws of the State of Indiana, United States, without regard to conflict of law principles.
For users in the European Economic Area and the United Kingdom, data processing is governed by our Privacy & Compliance Policy and by applicable data protection law, including the General Data Protection Regulation. Nothing in these terms is intended to limit or override any mandatory consumer protection or data protection right granted to you under the law of your country of residence.
EdgeXene LLC may assign or transfer these terms, and any rights or obligations under them, without your consent. You may not assign or transfer these terms without EdgeXene LLC's prior written consent.
Sections relating to intellectual property, disclaimer of warranties, limitation of liability, indemnification, dispute resolution, governing law, export control, and any other provisions that by their nature should survive, remain in effect after these terms end.
PATANYX contains cryptographic functionality, including an encrypted password vault and a WireGuard tunnel client, and is subject to United States export control laws and regulations, including the Export Administration Regulations. You represent that you are not located in, and will not download, use or re-export PATANYX to, any country or person subject to United States embargo or sanctions, and that you are not on any United States government restricted-party list.
You are responsible for compliance with the import, use and export laws of your own jurisdiction. Some countries restrict the use of encryption software or of VPN technology.
These terms, together with the Apache License, Version 2.0 and the Privacy & Compliance Policy, constitute the entire agreement between you and EdgeXene LLC regarding PATANYX, and supersede any prior understanding on the subject.
23.1 What it is. Premium is an optional paid term that unlocks private chat, checking a page against what a contact was served, reading text out of an image, and accent theme packs. The built-in tunnel is free, and so is the browser and every other feature. Buying Premium is not required to use PATANYX.
23.2 How it is licensed. Your Premium term is delivered as a signed token, shown to you on screen immediately after payment. You paste it into the browser's vault once, and your own copy of the browser verifies it offline. There is no account and no sign-in.
23.3 Save your token. It cannot be replaced. EdgeXene collects no email address of its own and sends you no email at any point: no receipt, no invoice and no token. Our payment processor collects an email address to run the transaction, under their own terms. Your token appears on a page immediately after payment, which you can print or save for your own records. That page is the only delivery, and you are told so before you pay as well as after.
EdgeXene will not re-send, recover or reissue a lost token, and has no way to reach you if you ask: no email address of yours is held, and the token is bound to no account or identity we could match you to. Keep the page as you would any other credential. This is the same property that makes the vault unrecoverable, and it is deliberate: we cannot lose what we never hold, and neither can anyone who compels us.
23.4 Billing. Payment is taken by our payment processor, whose own terms govern the transaction. Premium is sold as a prepaid term of a fixed length. It is a single payment: nothing renews automatically and no payment method is kept on file for a future charge. Prices and terms may change for future purchases; a change never applies to a term you have already paid for.
23.5 Ending and buying again. There is nothing to cancel: a term is a single payment that simply runs out. Your Premium term runs to the end of the period you paid for, and stops there unless you buy another. What happens when it ends is set out in 23.7.
23.6 Refunds. If Premium does not work as described, tell us and we will refund you. Beyond that, payments for a term already begun are not refundable, except where the law of your country gives you a right to a refund, which this section does not limit. Consumers in the European Union and the United Kingdom keep their statutory withdrawal and cancellation rights in full.
23.7 What happens when a term ends. When your Premium term runs out, the Premium features stop working until you buy another term. All of them, including ones released before you bought. We do not operate a partial or reduced Premium tier, and we would rather say so plainly here than have the browser surprise you. Your token is not deleted and nothing phones home to switch anything off: the token simply carries the date its term ends, and your own copy of the browser stops honoring it after that date.
The free browser is never affected, and free features always remain free. Nothing you created is deleted, locked or held back: anything you saved with Premium in use stays yours and stays readable. Your data is on your device, and EdgeXene holds no copy of it to withhold.
23.8 Availability. Chat depends on a relay EdgeXene operates. We do not guarantee uninterrupted availability of that relay, and Section 6 applies to it. Where an outage is prolonged and material, we will extend affected terms rather than leave you short.
23.9 Honest limits. A license check that runs on your own machine can be bypassed by someone who modifies their own copy of the software. We have chosen not to build the tracking, machine binding or activation controls that preventing this would require. Circumventing the license check is nonetheless a breach of these terms, and the Apache License does not grant a right to evade payment for a service EdgeXene operates.
